Alternative Dispute Resolution (ADR)

ADR is the commonly used acronym for the umbrella term “alternative dispute resolution.” ADR encompasses a broad spectrum of out-of-court conflict management and dispute resolution processes, ranging from direct negotiation between parties to mediation and arbitration. Mediation and arbitration introduce a neutral third party into the dispute resolution process.

ADR mechanisms, such as arbitration and mediation, offer businesses and citizens an effective and efficient method for resolving a broad range of disputes through alternatives to formal court proceedings. ADR is a complement to, not a replacement for, the court system but it does add additional choices for parties who have had a dispute. ADR offers many advantages over traditional court resolution of disputes; in particular by being much faster, but also offering confidentiality, and greater specific expertise than judges may possess concerning the subject matter in dispute (e.g., construction engineers serve on arbitration panels resolving disputes over the construction of a building).

Alternative Dispute Resolution – both Mediation and Arbitration – are available in Kosovo through a variety of organizations and avenues.
